Former St. Xavier employee accused of sex with student to remain out of jail

The former St. Xavier High School program supervisor facing sexual battery charges for an alleged relationship with a student will remain out of jail as she awaits trial, court documents show.
Emily Nutley, 42, pleaded not guilty Wednesday and was given an own recognizance bond, which means she did not have to post any money. The bond entry was signed by Hamilton County Common Pleas Judge Jennifer Branch.
Officials said Nutley, a married mother of three, was processed at the county jail and released. Prosecutors agreed to the own recognizance bond.
Her attorney, Joseph Suhre IV, told The Enquirer Thursday that his office has asked law enforcement to provide the evidence in the case, so they can thoroughly review it.
"We are committed to ensuring that Emily's case is handled with the utmost fairness, professionalism and efficiency," Suhre said in an email. "And we will make every effort to resolve this matter as expeditiously as possible."
Nude photos, texts
The allegations against Nutley date back to the fall of 2023, when she was supervising a program that assisted students at the all-boys Catholic high school who were struggling with academics, according to prosecutors. It was while working in that program that she met the 17-year-old student and began to have additional contact with him outside of school.
That contact included Nutley sending the boy nude photos of herself and sexually explicit messages via text, prosecutors said.
According to the indictment, Nutley and the student engaged in sex acts on two days in November 2023. Then in December 2023, they had sex, the indictment says.
As a condition of bond, Nutley, who lives in Mason, is not allowed to have contact with the student and can't travel outside of Hamilton or Warren counties.
