Illinois man given pretrial release, charged with hiding ex-girlfriend’s body

CHICAGO, Ill. (WTVO) — A 26-year-old Mount Prospect man has been released from custody after being charged with hiding his ex-girlfriend's dead body.

Juan Pio Toto is accused of concealing the death of Atalia Pucheta Martinez, 23, whose body was found in woods within Busse Woods in Elk Grove Village on November 9th.

Mount Prospect authorities said Toto confessed that he and Martinez had been arguing in the parking lot of their apartment complex early that morning, and that she had fallen and hit her head.

He then told police he put her body in his vehicle and drove to the wooded area where he left her.

Toto was with concealment of a death, a charge that is not considered a detainable offense under the Pretrial Fairness Act, according to the Cook County State's Attorney's Office.

He was released under electronic surveillance and ordered to surrender his passport, remain in the state, and avoid contact with Martinez's family.

The Cook County Medical Examiner has not yet given the official cause of death, and police said the investigation is still on-going and further charges may be possible.

Toto is due back in court on December 6th.
