Man shot by police while allegedly resisting arrest ordered held without bail

Twice within a matter of days, Kevin M. Burke allegedly tried to drive away from police with officers hanging out of his driver's side window, authorities said.

On the second occasion, which took place outside a Red Roof Inn in Mansfield Thursday, Burke was taken into custody after police shot him in the arm, authorities said.

Burke, 40, was arraigned in Attleboro District Court Friday on multiple charges stemming from his two attempts to avoid arrest, records show. He was also charged with drug trafficking after fentanyl was allegedly found on him while he was being treated for the gunshot wound in Sturdy Memorial Hospital.

On Sunday around 5 p.m., Burke was sitting outside his BMW at Mount Hope Cemetery in North Attleborough, police wrote in court papers. When officers tried to stop him in connection to arrest warrants, Burke allegedly jumped into his car and tried to drive away, but the car was in park, according to police.

Two police officers reached inside the black sedan and tried to pull Burke out of the driver's seat, but he locked his arms and legs and resisted, police said. At that moment, a person in the passenger seat put the vehicle into gear and they drove out of the cemetery, narrowly missing several people, police said.

On Thursday, police tracked Burke to the Red Roof Inn, where four officers were waiting when he left his room. But he managed to jump into his car before he was taken into custody, police said.

Officers broke his driver's side window and tried to shut off the car, police said. But Burke sped forward with an officer, Ryan Mooney, "attached to the driver's side of the vehicle."

Another officer ordered Burke to stop the car or he would be shot, police said.

"Mr. Burke then reverses the vehicle quickly, getting back to just about the same parking space he originally occupied," police wrote. "With the vehicle not in motion, but still running, [Mooney] can be seen continuing to physically struggle with Mr. Burke."

A second officer then broke the passenger-side window and ordered Burke to shut off the car, police wrote. The officer, whose name was not disclosed in court records, "appears to fire a single close-range gunshot into Mr. Burke's vehicle," police said.

"Mr. Burke then drives forward at a high rate of speed, causing Lieutenant Ryan Mooney to subsequently roll off the vehicle as Mr. Burke flees the scene," police said.

The entire sequence lasted one minute, police said.

A short time later, witnesses reported a BMW with a shattered window parked at a martial arts academy. Burke was not in the car but was found nearby and after a brief foot chase he was taken into custody.

Burke pleaded not guilty at his arraignment and was held without bail pending a dangerousness hearing scheduled for next Friday, records show.

Burke, who has addresses in North Attleborough and Bridgewater, is also wanted by Rhode Island authorities in connection to a 2022 arrest for allegedly speeding from police, breaking into a building with felonious intent, and failure to stop after a crash, according to court records.
