North Dakota AG Wrigley says cities can't set separate recall rules

North Dakota Attorney General Drew Wrigley has issued an opinion stating that home rule charter cities do not have the authority to create their own recall process for elected officials, apart from the process set forth in state law.

Wrigley noted that strict construction applies in defining municipal powers, meaning any ambiguity regarding a city's authority, including for cities such as Dickinson, must be resolved in favor of state law rather than the municipality.
