Davenport man bites officer – and leaves mark – in dog incident: Court records
A Davenport man was arrested Wednesday after police say he fought back against Animal Control over a vicious dog complaint, court records say.
According to the criminal complaint filed in Scott County Court, Davenport Police responded to the 300 block of Paul Revere Place to help Animal Control with an uncooperative person on Wednesday, November 6 at about 7:20 p.m. The defendant, Rory Schmidt, age 30, was being investigated by Animal Control for a dog at large/vicious dog complaint about his dog. When police arrived, Schmidt had opened a marked Animal Control vehicle, placed his dog in the driver compartment and tried to enter the vehicle himself. Schmit refused to remove his dog from the vehicle for a period of time.
Once he was removed, Schmidt walked away from Animal Control/police officers without speaking to them or identifying himself. He was ordered to stop by a uniformed police officer on the scene and refused by continuing to walk away and around several apartment buildings. Schmidt purposefully lengthened the leash, allowing his dog to advance and bite at officers, according to the criminal complaint. Animal Control officers used snares to control the aggressive dog, but Schmidt attempted to physically stop them by removing the snares.
Affidavits show Schmit had to be physically removed by police, leading to an arrest. Schmidt refused to follow commands during the arrest, leading to a lengthy physical altercation on the ground where he physically resisted by pulling his arms away and tried to stand up while yelling. Schmidt is accused of purposefully biting the officer on his left forearm through two layers of clothing for several seconds. This left a full teeth mark outline on the officer's forearm, causing pain. When two more officers arrived, Schmidt continued to fight and had to be placed in a full body "WRAP" restraint before being taken to the Scott County Jail.
He was arrested and charged with assault on a police officer resulting in bodily injury, a misdemeanor, and interference with official acts, also a misdemeanor. He was released on a $4,000 bond and has a preliminary hearing on November 26 in Scott County Court.
