Driver Was Drunk In Crash That Killed Motorcyclist: Passaic Prosecutor

The deadly collision took place at the intersection of Paulison Avenue and Pennington Avenue in the city of Passaic, according to Police Chief Luis Guzman and County Prosecutor Camelia M. Valdes. Officials did not say exactly what time the crash happened.

According to officials, the motorcyclist was going through the intersection when he was hit by 32-year-old Johnny Aguilar, who was behind the wheel of a Ford Excursion. Responding officers found the victim, identified as 59-year-old Carlos Ocasio-Rodriguez, in the middle of the intersection.

First responders took Ocasio-Rodriguez to Saint Mary's Hospital, where he was later pronounced dead.

"It was determined that Johnny Aguilar's blood alcohol content was over the legal limit at the time of the collision," officials said.

Aguilar was charged with second-degree death by auto; if convicted, he could spend between five and 10 years in prison. As of the latest update, he was in custody awaiting a first court appearance.
