LI Man Caught With Drugs And Guns Gets 10 Years In Prison: DA A Long Island man was sentenced to 10 years in prison for possessing a loaded gun, fentanyl pills, cocaine, and amphetamine, the DA says.WEST BABYLON, NY — A West Babylon man was sentenced to 10 years in prison for drugs and firearms charges, Suffolk County District Attorney Raymond A. Tierney announced.
Joshua Oltchick, 26, of West Babylon, was sentenced to 10 years in prison on Monday for criminal possession of a controlled substance and attempted criminal possession of a weapon after illegally possessing over 2,700 pressed fentanyl pills and a loaded firearm, the DA said.
According to the investigation, on Sept. 16, 2023, Suffolk County police responded to a report of a man slumped over behind the steering wheel of a parked vehicle at the corner of 7th Avenue and 15th Street in West Babylon, the DA said.
Upon arrival, police noticed that the defendant's vehicle was parked facing the wrong direction with its engine still running, approached the vehicle and saw a firearm between the defendant's legs on the driver's seat, which was a loaded Beretta USA Corp. .380 auto caliber semiautomatic pistol, the DA said.
The officer opened the door, turned the engine off, and searched the vehicle, finding 8.25 ounces of pressed fentanyl pills, 1,930 milligrams of cocaine, and 1,080 milligrams of amphetamine, all packaged in a manner consistent with street-level drug sales, the DA said.
Detectives also found drug packaging material, dilutants that are used to extend the supply of narcotics, two digital scales, two cell phones, and $3,319 in cash, the DA said.
"Every fentanyl pill that this armed prior felon intended to sell in Suffolk County is a potentially fatal overdose and, thankfully, our Suffolk County police officers interrupted his crimes with good police work," Tierney said. "This ten-year sentence should send the message that we will not tolerate those who sell poison in Suffolk County."
On Oct. 2, Oltchick pleaded guilty before Acting Supreme Court Justice Steven Pilewski to second-degree criminal possession of a controlled substance, a Class A felony, and second-degree attempted criminal possession of a weapon, a Class C violent felony, the DA said.
On Nov. 4, Oltchick was sentenced to 10 years in prison followed by five years of post-release supervision, the DA said. He was represented by David Adhami who was not immediately available for comment.
Oltchick has a prior conviction from 2022 for third-degree criminal possession of a controlled substance, the DA said.
