Man charged after person killed in alleged drunk driving accident in Buckhannon

BUCKHANNON, W.Va. (WBOY) — A man who was allegedly driving while drunk was charged after he was involved in a collision that killed one person in Upshur County over the weekend.

On Nov. 2, officers with the Buckhannon Police Department were dispatched to a two-vehicle accident on W.Va. Rt. 33 in front of Pizza Hut, according to a criminal complaint.

When officers arrived, EMS workers who were already on scene said that "an unidentified driver in the second vehicle was deceased," and that a black truck "was unoccupied," officers said.

A witness to the incident told officers that a man, later identified as Joshua Foster, 33, "took off behind Pizza Hut," the complaint.

Foster later walked toward officers from that area, and said "he was the driver of the truck" and "admitted to having alcohol before going for a drive to 'clear his head'," officers said.

Suspect allegedly shot at road work crew in Ritchie County

After Foster spoke with the officers, he "started stumbling and was assisted to an ambulance," and officers "informed him he was under arrest for suspicious of DUI" and read his Miranda rights, according to the complaint.

Upon begin given his Miranda statement, Foster "admitted to drinking before driving" and Foster "did blow a .242 on a preliminary breath test," officers said.

Foster has been charged with DUI causing death. He is being held in Tygart Valley Regional Jail on $500,000 cash-only bond.

The victim was not identified in the complaint.
