Former Buckhannon mayor will remain in custody until federal child porn trial

CLARKSBURG, W.Va. (WBOY) — The former Buckhannon mayor charged with producing child pornography will remain in jail until his federal trial in Clarksburg later this year.

During a detention hearing that concluded on Thursday, a federal magistrate judge ordered that David McCauley, 66 of Buckhannon, remain in U.S. Marshals Service custody until his trial, which is scheduled for Dec. 9.

McCauley was indicted on two counts of production of child pornography and one count of possession of child pornography at the beginning of the month and was placed in custody two days later after a preliminary detention hearing . He allegedly began a sexual relationship with a 16-year-old victim and allowed the victim to move in with him "when the alleged victim was in a vulnerable state."

Multiple people testified during the detention hearing that McCauley and the alleged victim had a "parent-child type relationship," but the U.S. Attorney's Office for the Northern District of West Virginia alleges that McCauley enticed the boy "to engage in sexually explicit conduct for photo and video production" when he was 17 years old.

The detention order says that McCauley "is a danger to the community by clear and convincing evidence." He is still detained in the Northern Regional Jail.

Also on Thursday, a different federal judge ordered a change in location for McCauley's December trial from Elkins to Clarksburg, West Virginia.

McCauley was mayor of Buckhannon from 2016-2020 and was a member of the Buckhannon City Council until he resigned last week .
