Tracey's husband, however, is under investigation for a domestic violence indecent that happened in Berrien County, where Tracey lived, according to news reports.
Since Tracey's husband has control over her remains, Tracey's parents asked a Michigan judge to grant them possession of their daughter's remains and the right to control her funeral, according to news reports.
The judge ruled in the parents' favor on Tuesday, allowing the Chicago medical examiner to delay releasing the remains, according to news reports.
A Chicago-area judge is expected to decide whether to lift the temporary restraining order preventing the medical examiner from releasing Tracey's body on Friday.
