NEW BUFFALO, MI — The parents of a Michigan woman who died in Chicago last month are fighting to get their daughter's body back , according to new reports.

Caitlan Tracey, 36, of New Buffalo, was found dead in an apartment stairwell in downtown Chicago after police said she fell 24 floors in her husband's high rise on the 1200 block of Prairie Street on Oct. 27, according to new reports.

Investigators questioned Tracey's husband, but later released him without any charges in connection to the incident, according to new reports.

Tracey's husband, however, is under investigation for a domestic violence indecent that happened in Berrien County, where Tracey lived, according to news reports.

Since Tracey's husband has control over her remains, Tracey's parents asked a Michigan judge to grant them possession of their daughter's remains and the right to control her funeral, according to news reports.

The judge ruled in the parents' favor on Tuesday, allowing the Chicago medical examiner to delay releasing the remains, according to news reports.

A Chicago-area judge is expected to decide whether to lift the temporary restraining order preventing the medical examiner from releasing Tracey's body on Friday.
