Michigan dam saga likely to head before court of appeals for oral arguments, officials say

MIDLAND, MI – The Four Lakes Task Force is asking the Michigan Court of Appeals to affirm a local judge's prior ruling that a special assessment district in Midland and Gladwin counties is valid, and residents should pay a portion of the costs to repair the damaged dams.

In July, the Heron Cove Association appealed Midland County Circuit Court Judge Michael J. Beale's June 20 ruling dismissing a challenge of the task force's lake level special assessment. As part of a continued legal back-and-forth, the task force on Wednesday, Sept. 18, filed a brief in the Michigan Court of Appeals, asking the higher court affirm Beale's decision.
