Woman who shot food truck worker in Albuquerque sentenced to probation

ALBUQUERQUE, N.M. (KRQE) – An Albuquerque woman who shot a food truck worker in downtown Albuquerque will not spend any time behind bars. Back in May 2023, Ambrosia Mirabal shot toward her child's father telling police she was trying to scare him for talking to another woman. The bullet missed him instead striking a worker in a taco truck near Third and Central.

Mirabal took a plea deal in March and pleaded guilty to one count of aggravated battery with a deadly weapon. Judge Bruce Fox gave Mirabal five years of supervised probation citing her lack of criminal history and following court orders through the last year. "I don't think a term of imprisonment will keep the community any safer. I feel confident that by ordering strict terms of probation, she'll comply with those terms," said Judge Fox.

He also gave Mirabal a conditional discharge which means the charge could be dropped from her if she completes probation.
