A suspicion of infidelity and the alleged use of a gun have one man facing charges of assault, reckless conduct and unlawful discharge of a firearm, all as misdemeanors.

Karl Kebwe Roosevelt Sos was arrested about an hour past midnight on Tuesday at his residence in Dededo after another man, his alleged victim, spoke with police officers about their alleged encounter earlier that night.

According to a magistrate's complaint filed in the Superior Court of Guam, the man said he heard a knock on his front door at the Mirage Apartments in Tamuning around 11:36 p.m. He observed another man wearing a dark hoodie, later identified in the complaint as Sos. The man reportedly followed Sos down a set of stairs and made contact in the parking area.

"The victim stated that the defendant (Sos) extended his hand as if to shake it, however, the defendant gripped the victim's hand tight and refused to release it. The defendant then pulled a gun from the right side of his waistband and pointed the barrel of the firearm directly at the victim's face before facing it down at his left side," the magistrate's complaint stated.

Based on the complaint's description of events, the man did not appear to recognize Sos at this point.

The complaint stated that the man attempted to pull away, but Sos allegedly would not let go. A woman known to the man, identified in the complaint as Sos' girlfriend, approached the two and reportedly told Sos to let the man go.

"The defendant then became angry and accused (his girlfriend) of cheating on him with the victim, and at that time, the victim recognized the defendant through previous contact via Facebook Messenger, where he had made similar allegations," the magistrate's complaint stated.

Sos' girlfriend tried to tell him that there was no relationship between her and the man, but Sos allegedly became increasingly angry, according to the complaint.

"The defendant released his grip on the victim, pulled back the slide of the gun, then fired a single shot into the air. The victim was fearful the defendant was going to shoot him and remained still so as not to further disturb the defendant, who was already visibly upset. The victim was in fear for his safety throughout the incident," the complaint stated, adding later that police confiscated a 9 mm shell casing from the scene.

According to the complaint, the man's wife and mother corroborated his statement.
