Davison County felony court cases for Nov. 5
Nov. 7—MITCHELL — The following cases were among those heard Tuesday, November 5, during a circuit court session at the Davison County Public Safety Center, with Judge Chris Giles presiding:
* Allen Thomson, 31, of Mitchell, appeared in court for a motions hearing. Thomson is facing a Class 1 misdemeanor charge of obstructing police and a Class 6 felony for aggravated eluding, a Class 6 felony. A jury trial is scheduled for December.
* Princella Blackspottedhorse, 28, of Mitchell, pleaded not guilty to manufacturing/distribution/possession of drugs and a drug-free zone violation, both Class 4 felonies, and to possession of a controlled substance (methamphetamine), a Class 5 felony. She faces up to 25 years in prison and/or a $50,000 fine, with a minimum sentence of six years. Her request for a personal recognizance (PR) bond was denied. A jury trial is set for February.
* Spencer Spillman, 18, of Alexandria, pleaded not guilty to third-degree burglary, a Class 5 felony that carries a potential penalty of up to five years in prison and/or a $10,000 fine. A jury trial is scheduled for February.
* Brandon Spillman, 19, of Alexandria, pleaded not guilty to third-degree burglary, a Class 5 felony that carries a potential penalty of up to five years in prison and/or a $10,000 fine. A jury trial is scheduled for February.
* Shelly Klapkin, 57, of Mitchell, pleaded not guilty to the use or possession of drug paraphernalia, a Class 2 misdemeanor, and to possession of a controlled substance and the unauthorized ingestion of controlled substances, both Class 5 felonies. Klapkin, an employee of Freedom Valu Center, was implicated in a drug raid that took place in early October. During the search of the premises, law enforcement discovered a pink bag concealed beneath a cigarette display. Klapkin acknowledged ownership of the bag but initially denied that the syringe found inside belonged to her. A jury trial is scheduled for February.
* Arvin Aaberg, 54, of Sioux Falls, pleaded not guilty to possession of a controlled substance (meth), a Class 5 felony, and to the manufacturing/distribution/counterfeit/possession of meth. The court denied Aaberg a PR bond. He is facing up to 20 years in prison and/or a $40,000 fine, with a minimum sentence of one year. A jury trial is scheduled for February.
* Isaac Brown, 33, of Sioux Falls, appeared in court for a motions hearing where a plea deal was reached. Brown pleaded guilty to the use or possession of drug paraphernalia, a Class 2 misdemeanor. In exchange, the charge of possession of a controlled substance, a Class 5 felony, was dismissed. The court sentenced Brown to 30 days in jail, with credit for three days already served. The remaining 27 days were suspended. Additionally, Brown was ordered to pay a $200 fine and placed on one year of probation.
* Risa Sanborn, 43, of Lower Brule, made her initial court appearance on two drug-related charges, possession of a controlled substance, a Class 5 felony, and unauthorized manufacturing/distribution/counterfeiting of methamphetamine, a Class 3 felony. Sanborn is set to be arraigned in two weeks. A $10,000 cash bond was set. A jury trial is scheduled for February.
* Teresa Chipps, 18, of Rapid City, appeared in court on a grand theft in the amount of $2,500-$5,000, a Class 4 felony. Chipps filed for a court-appointed attorney and will be rescheduled for arraignment in two weeks. She is facing up to five years in prison and/or a $10,000 fine.
* Jonathan Abdo, 46, of Mitchell, appeared in court for a violation of the 24/7 program. Abdo faces a charge for possession of a controlled substance (Tramadol), and new charges are being filed against him. Judge Giles ordered Abdo to serve 48 hours in jail for the violation. A jury trial is scheduled for February.
* Matthew Ruff, 19, of Mitchell, pleaded not guilty to third-degree burglary, a Class 5 felony that carries a potential penalty of up to five years in prison and/or a $10,000 fine. A jury trial is scheduled for February.
* Lance Shields, 21, of Mitchell, pleaded not guilty to the use or possession of drug paraphernalia, a Class 2 misdemeanor and to two counts of possession of a controlled substance. A jury trial is scheduled for February.
* Craig Maas, 41, of Mitchell, pleaded guilty to possession of a controlled substance with the intent to distribute (meth). In a plea deal, charges of drug paraphernalia possession, possession of two ounces or less of marijuana, both Class 2 misdemeanors, and two counts of controlled substance possession (meth and cocaine) were dismissed. Maas faces a minimum mandatory sentence of one year. Judge Giles ordered a pre-sentencing report, with sentencing scheduled for December 17.
* Isaias Lucas Niz, 23, of Plankinton, pleaded not guilty to driving without a license, a Class 2 misdemeanor, first-offense driving under the influence (DUI), a Class 1 misdemeanor, and abuse/cruelty to a minor under 7, a Class 3 felony. Court documents state Niz was stopped while driving intoxicated with a female passenger holding a 1.5-year-old child without proper restraints. A jury trial is scheduled for February.
* Mark Rigdon, 61, of Mitchell, pleaded not guilty to several charges, including threatening a law enforcement officer, reckless use of weapons, possession of a loaded firearm while intoxicated, all Class 1 misdemeanors, and aggravated assault with a deadly weapon, a Class 3 felony. According to court documents, Rigdon was target shooting on a trail leading to private property, firing in the direction of a home and cattle. When confronted by the landowner, he allegedly threatened violence and fired three rounds into the ground next to the complainant's vehicle. While being transported to jail, Rigdon reportedly told a female trooper he could "cap" her without warning. A jury trial is scheduled for February.
* Dakota Rouse, 38, of Marty, was sentenced for a fourth-offense DUI, a Class 5 felony. The court imposed a five-year prison term, with credit for 232 days already served. The entire sentence was suspended. Rouse was also fined $750, placed on three years of probation and had her driver's license revoked for three years. Rouse was accepted into the James Valley Drug and DUI Court program.
* Randy Hedge, 38, of Tea, was sentenced for multiple offenses, including possession of drug paraphernalia and driving with a suspended license, both Class 2 misdemeanors, as well as possession of meth and unauthorized ingestion of hydrocodone, both Class 5 felonies. Hedge was given a five-year prison sentence, which was entirely suspended, with credit for three days already served. Additionally, he was ordered to pay a $750 fine.
* Matthew Messer, 42, of Mitchell, pleaded not guilty to distribution/possession with the intent to distribute one ounce or less of marijuana, a Class 6 felony. A jury trial is scheduled for February.
* Alexander Drapeau, 18, of Mitchell, pleaded not guilty to several charges, including multiple Class 2 misdemeanors such as speeding, driving without a license, under-21 DUI, possession of drug paraphernalia, throwing a substance on the highway with intent to damage, possession of two ounces or less of marijuana and obstructing police. He also faces a Class 6 felony for second-degree eluding. Court documents reveal that during a chase, Drapeau threw beer cans out the window at law enforcement. After stopping the vehicle, Drapeau and two passengers fled on foot and were later apprehended in a field. A jury trial is scheduled for February.
* Cleveland Skunk, 32, of Mitchell, failed to appear in court for a bond forfeiture hearing. Skunk is facing charges of domestic abuse simple assault, a Class 1 misdemeanor, and a third-offense domestic abuse simple assault, a Class 6 felony. As a result of his absence, Skunk's bond was revoked.
* Trenton Zeigler, 34, of Mitchell, admitted to a probation violation. Zeigler was serving probation for a possession of a controlled substance charge. Zeigler was sentenced to five years in prison, with credit for 26 days already served. The entire sentence was suspended. His two-year probation was restarted, and he was ordered to serve three days in jail. Additionally, his previous suspended imposition of sentence was revoked.
* William Frederick, 29, of Sioux Falls, pleaded guilty to a second-degree escape by a prisoner, a Class 5 felony. Frederick was sentenced to five years in prison with a seven-day credit for time served, but the entire sentence was suspended. Frederick was placed on two years of probation.
* Lando Edoff, 20, of Mitchell, pleaded not guilty to possession of drug paraphernalia and driving with a suspended license, both Class 2 misdemeanors, and to possession of a controlled substance (meth), a Class 5 felony. A jury trial is scheduled for February.
* Will Jellis, 46, of Mitchell, pleaded not guilty to violation of a protection order, a Class 6 felony, and to domestic abuse simple assault — strangulation and aggravated assault, both Class 3 felonies. A jury trial is scheduled for February.
* Tina Hauge, 46, of Mitchell, pleaded not guilty to several drug charges, including possession and unauthorized ingestion of a Schedule I or II controlled substance (meth), both Class 5 felonies, possession of a Schedule III or IV controlled substance (suboxone), a Class 6 felony and to possession of drug paraphernalia, a Class 2 misdemeanor. A jury trial is scheduled for February.
* Chloe Dutchuk, 18, of Mitchell, pleaded not guilty to third-degree burglary, a Class 5 felony that carries a potential penalty of up to five years in prison and/or a $10,000 fine. A jury trial is scheduled for February.
* James Gruber, 67, of Mitchell, pleaded guilty to simple assault and petty theft over $400, both Class 1 misdemeanors. As part of a plea agreement, charges of identity theft, a Class 6 felony, and terrorist threats, a Class 5 felony, were dismissed. Gruber was sentenced to 96 days in jail with credit for 16 days already served and 80 days suspended.
* John Clifford, 48, of Sioux Falls, pleaded guilty to false impersonation with intent to deceive, a Class 1 misdemeanor. As part of a plea agreement, several charges were dismissed, including possession of drug paraphernalia, a Class 2 misdemeanor, obstructing police and driving with a revoked license, both Class 1 misdemeanors, and possession of a controlled substance, a Class 5 felony, were dismissed. Clifford was sentenced to 48 days in jail, received a credit of 18 days already served and had 30 days suspended.
* Joseph Moyer, 42, of Huron, had a motions hearing regarding two charges he faces, possession of drug paraphernalia, a Class 2 misdemeanor, and possession of a controlled substance (meth), a Class 5 felony. A pretrial conference is set for December 3, with a jury trial scheduled for the following seek.
* Mark Pretre, 30, of Mitchell, was sentenced for manufacturing/distribution/possession of Schedule I/II drugs, a Class 4 felony. This marked Pretre's fifth felony conviction in eight years. Both State's Attorney Katie Mallery and Judge Giles noted that Pretre had transitioned from personal addiction to distributing drugs, thereby posing a threat to society. Pretre was sentenced to 10 years in prison, with five years suspended. He was credited 21 days for time already served and fined $1,000.
