LAS VEGAS ( KLAS ) — A prison sentence for a former high school janitor arrested for having a sexual relationship with a North Las Vegas student is in limbo. Devyn Hudson's sentencing hearing was scheduled for Oct. 10 in Clark County District Court, but it was postponed and no new date has been set, according to court records. Court records stated Hudson's attorney wanted to delay sentencing because he wanted to subpoena school records. Hudson was 27 when he was arrested in March . He was arraigned June 20 after being indicted by a Clark County grand jury two weeks earlier. He was working at Canyon Springs High School as a janitor and the teen he had sex with was a student there. Detectives with the North Las Vegas Police Department said Hudson sexually assaulted the teen on Feb. 29. 8 News Now obtained several Instagram messages police obtained as part of their evidence in the case. At 2:26 p.m., Hudson messaged the teen that he was in "the 900," a section of the school, and said, "meet you in the 500 [in] a few." Nearly two hours later, he wrote the teen, "I'm glad you enjoyed it and so did I." According to North Las Vegas police, Hudson picked an area at Canyon Springs without cameras. The teen tried leaving several times but police said Hudson instead forced himself on her. The teen eventually confided with a school counselor that she'd been assaulted, who then contacted police, according to an arrest report. Clark County prosecutors initially charged Hudson with sexual assault with a minor under 16 years of age; attempt sexual assault with a minor under 16 years of age; lewdness with a child under the age of 16; and statutory sexual seduction. Yet, Hudson pleaded guilty in Clark County District Court in July to a lesser charge. "Mr. Hudson today is going to plead guilty to sexual conduct between certain employees and volunteers between school and pupil," Robert Arroyo, Hudson's attorney, said on July 11. "The state will make no recommendation at the rendition of sentence." Hudson will have to register as a sex offender as part of the plea, according to court documents. "You understand that the range of punishment for this offense is somewhere between one and five years in the Nevada Department of Corrections and there's a fine of up to $10,000?" Judge Erika Mendoza asked Hudson. Hudson responded, "Yes, ma'am."
